A written document in which one person (the principal) appoints another person to act as an agent on his or her behalf, thus conferring authority on the agent to perform certain acts or functions on behalf of the principal.

Documents required for General power of attorney (GPA)

• Identity Proof of power of attorney executant and power of attorney holder and witnesses.

• Ownership proof of property.
• Two passport size photographs of power of attorney executat and power of attorney holder.

Powers of attorney can be written to be either general (full) or limited to special circumstances. A power of attorney generally is terminated when the principal dies or becomes incompetent, but the principal can revoke the power of attorney at any time.

Execution under power-of-Attorney

The donee of a power-of-attorney may, if he thinks fit, execute or do any assurance, instrument or thing in and with his own name and signature, and his own seal, where sealing is required, by the authority of the donor of the power; and every assurance, instrument and thing so executed and done, shall be as effectual in law as if it had been executed or done by the donee of the power in the name, and with the signature and seal, of the donor thereof.

1. The Power of Attorney is to be executed on a non-judicial stamp paper of the requisite value as per the stamp duty prevalent in the respective state.
2. Each page of the Power of Attorney is to be signed and wherever the blanks are filled in initialed by the Grantor (applicant executing the POA). The POA should be signed by the Attorney on the last page.

Special Power of Attorney

• Ownership proof of property.
• Two passport size photographs of power of attorney executat and power of attorney holder.

A special power of attorney narrows what choices the agent can make. You can even make several different POAs, with different agents for each.

Requirement for power of attorney embossing
(i) Full address of the executant.
(ii) Full address of the person in whose favour the documents are to be executed.
(iii) The place of property or the place where the powers to be delegated through that document, are be exercised.
(iv) Clear date should be mentioned in the document at the time of its execution.
(v) The document should be duly signed by the executant and witnessed by two persons giving their full addresses. This should also be attested by the Notary Public with seal.
(vi) The paper on which the document is executed should be of the same country in which it is executed.
(vii) The document to be embossed would be original and not its photocopy.
(viii) The document should be got embossed within three months of the date of execution at the headquarters or from the office of Commissioners of Divisions.

2. the persons residing in the foreign countries in the above said matters, it has now been decided that the executant should also be required to fulfil the following requirements in addition to those mentioned in para-1 above :
(i) The executant must mention his passport number in the document and affix his photograph on the relevant document duly attested by the Authority from whom the document is got attested.
(ii) The document should be accompanied with a copy of the passport of the executant up to date duly attested.
(iii) In addition to (i) and (ii) above the special power of attorney and general power of attorney must be got counter-signed from the office of the Indian High Commission or the Embassy of India in that country where it was executed with proper identification and verification by authorised officer before it is presented for embossing the present forgery.

When a document is presented for registration language unknown to registering officer , the translation shall be transcribed in the register of documents of the nature of the original, and, together with the copy, shall be filed in the registration office. the translation shall be treated as if it were the original.

That the principal may revoke the authority given to his agent at any time before the authority has been exercised so as to bind the principal. That the reasonable notice must be given of such revocation or renunciation, otherwise the damage thereby resulting to the principal or the agent as the case may be must be made good to the one by the other.
