Tatima Nama/Rectification deed and Modification deed

A mistake of fact in a deed can be rectified by mutual consent of the parties thereto who agree to vary add to or subtract form the terms of any earlier deed. Since intention of the parties must be expressed in the written instrument our oral evidence of such agreement is not admissible.
